1. Overview
By completing a purchase on The Auld Sod website, you (the "Purchaser") agree to the following terms and conditions of sale. These terms form a legally binding agreement between you and Buy and Irish Bog Limited T/A as The Auld Sod Ltd., having its registered office at Doonbeg, County Clare, Ireland.
2. Nature of the Product
Each purchase includes:
- A physical or digital Certificate of Ownership.
- A leasehold interest in a uniquely numbered plot of Irish bogland, for a term of 25 years.
- Access to a public viewing point at the entrance to the land.
This product is for personal and commemorative purposes and is not suitable for development or investment.
3. Leasehold Structure
Upon purchase, the named individual (the "Holder") will be granted a 25-year leasehold interest in the designated plot of land.
- This lease is non-transferable and may not be sold or assigned.
- The lease is renewable by the Holder every 25 years, free of charge, upon request.
- No annual rent is charged or payable.
- The lease is governed by the Deed of Assurance, accessed via the QR Code present on the holders Certificate of Ownership, which forms part of this agreement.
4. Gifting & Third-Party Purchases
If a plot is purchased as a gift:
- The Purchaser agrees that the named Holder is the legal leaseholder.
- The Holder is bound by these Terms and Conditions and the Deed of Assurance as though they were the Purchaser.
- By naming the Holder at checkout, the Purchaser affirms that they have the Holder's consent to provide their name and bind them to this agreement.
5. Certificate of Ownership
The Certificate of Ownership is a commemorative item that confirms the Holder’s name, plot number, and the location of the land.
- It is not a title deed or legal document of freehold ownership.
- By accepting this certificate, the Holder agrees to the terms outlined in the Deed of Assurance.
6. Use and Access
- The land is held in conservation and is not for commercial or personal use.
- Physical access to the individual plot is not permitted. A designated public viewing point is provided at the site entrance.
- Any visitor accessing the land beyond the viewing point, or traveling to the site, does so entirely at their own risk.
7. Refund Policy
As each certificate and lease is custom-created, refunds or cancellations are not available once the order has been processed. However, if you receive a damaged or incorrect certificate contrary to the information you placed on your order form, please contact us within 14 days of receipt for a replacement.
8. Assumption of Risk and Liability Waiver
The Holder and/or visitor acknowledges that the land is designated for conservation and access is restricted. The Auld Sod Ltd. shall not be held liable for any injuries, loss, or damage sustained by anyone accessing the land or approaching it, including public or private routes leading to the property. All visits to the area, whether permitted or otherwise, are made entirely at the individual’s own risk.
9. Legal Jurisdiction
This agreement, including the Deed of Assurance and any disputes arising under it, is governed by the laws of Ireland.
Any legal proceedings must be brought before the Irish courts.
